Section 47E-4 a seller may answer No Representation on the questions carrying that option, or discharge the duty by attaching an expert report. Mecklenburg Code Enforcement handles permitting for Charlotte and all 6 towns across 524 square miles, issuing over 100,000 permits and 320,000 inspections a year with more than 100 inspectors. N.C.G.S. Section 47E-7 requires prompt correction of material inaccuracies, and Section 47E-4.1 adds a separate boldface mineral and oil and gas disclosure. North Carolina charges excise stamps on the deed.
A useful and rarely mentioned consequence. Where a buyer intends to clear the site, the condition of the structure matters far less to them, which means the disclosure question carries less weight on that particular sale.
It does not disappear. The statutory obligations apply regardless of the buyer's intentions and concealment is still concealment. But an engineer's report that would be essential on a restoration file is worth less on a land file, because the building is not what is being bought.
